Terms of Service

    Terms of Service

    Effective November 8, 2026

These Terms of Service ("Terms") govern your use of moleculeclub.com, the Molecule Club patient portal, and the related services (together, the "Services") provided by F&Y Holding LLC, a Delaware limited liability company doing business as Molecule Club ("Molecule Club", "we", "us"). By using the Services you agree to these Terms, our Privacy Policy, Consent to Telehealth Services, Refund Policy, Cancellation Policy and Shipping Policy. If you do not agree, do not use the Services.

    1. What Molecule Club is and is not

Molecule Club is a technology and care-coordination platform. We connect you with independent licensed clinicians who evaluate you and, where appropriate, prescribe treatment, and with licensed pharmacies that fill and ship prescriptions. Molecule Club is not a medical provider, pharmacy or healthcare facility, does not practice medicine, and does not dispense medication. All clinical decisions are made by the clinician. Nothing on our website is medical advice.

    2. Eligibility

You must be at least 18 years old, located in the United States in a state where the Services are available, and able to form a binding contract. You must use the Services only for yourself, not on behalf of another person. By using the Services you represent that the information you provide is accurate and complete and that you will keep it current.

    3. Accounts

You are responsible for keeping your login details confidential and for all activity under your account. Notify us immediately at support@moleculeclub.com if you suspect unauthorized use. We may suspend or close accounts that violate these Terms.

    4. Medical services and prescriptions

    5. Pricing, payment and recurring plans

Prices are displayed at checkout and may change over time. By providing a payment method you authorize us and our payment processor to charge it for the amounts shown. If you purchase a recurring plan, you authorize recurring charges at the stated interval until you cancel. You may cancel at any time as described in our Cancellation Policy. Taxes and shipping, where applicable, are shown at checkout. You are responsible for keeping a valid payment method on file; if a payment fails, your order may be delayed or your plan paused.

    6. Refunds, cancellations and shipping

Our Refund Policy, Cancellation Policy and Shipping Policy are part of these Terms. In summary: you receive a full refund if a clinician does not prescribe; orders cannot be refunded once the pharmacy has filled the prescription; recurring plans can be cancelled at any time and take effect at the end of the current billing cycle; shipping costs are shown at checkout.

    7. Acceptable use

You agree not to: provide false information or impersonate anyone; use the Services to obtain medication for someone else or to resell medication; attempt to access another user's account or any non-public part of the Services; interfere with the operation or security of the Services; scrape or copy content without permission; or use the Services in violation of any law.

    8. Communications

By creating an account you agree to receive service emails about your account, orders and care. If you opt in to text messages, message and data rates may apply and you can reply STOP to unsubscribe. You may opt out of marketing communications at any time; service communications continue while your account is active.

    9. Intellectual property

The Services, including all content, design, trademarks and software, are owned by Molecule Club or its licensors and are protected by law. We grant you a limited, non-exclusive, non-transferable license to use the Services for your personal, non-commercial use in accordance with these Terms.

    10. Third-party services

The Services rely on third parties, including the telehealth platform provider, clinicians, pharmacies, payment processors and shipping carriers. We are not responsible for the acts or omissions of independent clinicians or pharmacies, who are solely responsible for the care and products they provide.

    11. Disclaimers

The Services are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Services will be uninterrupted or error-free, or that any treatment will produce a particular result. Individual results vary.

    12. Limitation of liability

To the fullest extent permitted by law, Molecule Club and its owners, officers, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or goodwill, arising out of or related to the Services. Our total liability for any claim arising out of or related to the Services will not exceed the amount you paid to us for the order giving rise to the claim in the twelve months before the claim arose. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

    13. Indemnification

You agree to indemnify and hold harmless Molecule Club and its owners, officers, employees and agents from any claims, losses or expenses, including reasonable attorneys' fees, arising from your breach of these Terms, your misuse of the Services, or your violation of any law or third-party right.

    14. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in Delaware, and you consent to the jurisdiction of those courts. Before filing a claim, you agree to contact us at support@moleculeclub.com and attempt in good faith to resolve the dispute informally for at least 30 days.

    15. Changes to the Services and these Terms

We may modify or discontinue any part of the Services at any time. We may update these Terms by posting a revised version with a new effective date. Material changes will be communicated by email or through the Services. Your continued use after the effective date constitutes acceptance of the revised Terms.

    16. General

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. These Terms, together with the policies referenced above, are the entire agreement between you and Molecule Club regarding the Services. You may not assign these Terms; we may assign them in connection with a merger, acquisition or sale of assets. Our failure to enforce any provision is not a waiver.
